The following terms and conditions of sale govern the sale of fine art prints by François Pitot via this website.
FINE ART PRINTS
Each print is unique and handcrafted in a limited edition of thirty copies. Except for special requests such as formats not offered in the store, mounting or framing, each print is sold individually. The rendering or tonality visible to the customer from the screen of his or her computer, tablet or mobile phone may vary according to the quality of the print. There may therefore be slight variations in rendering and color between the images visible on this site and the print received. These variations do not constitute grounds for return or cancellation of an order. Each print is checked, validated and signed by François Pitot before dispatch
Prices shown are net, excluding shipping costs and are not subject to VAT. No additional taxes will be applied for European Union countries. However, for other countries, including the UK, customs and import taxes may apply. In this case, taxes will be the responsibility of the customer upon receipt of the parcel. Shipping costs, to be borne by the customer, are invoiced in addition to the print price indicated online. These costs depend on the weight, volume and country of destination. The amount of shipping are displayed in the shopping basket when the order is confirmed and before payment, except in the case of special orders, mounting options or framing. All prices are subject to change without notice. It is understood, however, that the price appearing on the site at the time of the order will be the only one applicable to the buyer.
Payment for online orders is made exclusively in euros via the secure platform Paypal. Payment is made in full when the order is placed. Special orders will be subject to a quotation which will be returned validated and signed by the customer. No delivery will be made until payment has been received and cleared. All orders remain the property of François Pitot until full payment has been received.
A free pick-up service is available in Toulouse. You can choose this service when you place your order. For metropolitan France, shipment is by Colissimo with tracking, shipment fees are automatically calculated at the time of order. For other countries, shipments are made by Colissimo, then handed over to the local carrier in the destination country, with tracking. Upon delivery, the purchaser is required to check the conformity and good condition of the order when the package is presented to him/her. In the event of an open and/or damaged parcel, it is the buyer’s responsibility to refuse the parcel and make reservations on the delivery note in accordance with the provisions of article L.133-3 of the Code du Commerce. All orders are shipped from Toulouse in France.
In accordance with the law, the buyer located in France has a period of 14 working days from delivery of the order to return the products for exchange or refund. Products must be returned in perfect condition for resale. Prints must not have suffered any marks, folds, knocks or fingerprints of any kind, and must be returned in their original original packaging, duly sealed. Failing this, François Pitot may refuse the exchange or refund. The return will be at the buyer’s expense.
Any product not returned within the 14-day cooling-off period will be deemed to be in conformity with the order and accepted by the purchaser. Withdrawal cannot be requested before delivery of the products. Custom-made prints and framing to customer specifications are excluded from the right of withdrawal. Exchanges of e-mails are proof of the personalization of the order. International sales are final and are not subject to the above conditions of return and retraction.
In accordance with the French Intellectual Property Code, François Pitot remains the author of the prints purchased and the sole beneficiary of the exploitation rights attached to them, which he may transfer at his convenience, without informing or accounting to the customer purchasing an art print. As such, the customer who purchases an art print becomes the owner of the physical object sent to him/her, and may only dispose of it for his/her own use. (decoration of a public or private space). Ownership of the object (print) does not confer any rights over the image (work of the mind). Under no circumstances may he copy, use or exploit the image, whatever the purpose of such use and whatever the medium. This prohibition applies to both commercial and voluntary use. Any such use must be be negotiated separately and be the subject of a transfer of exploitation rights.
